The IRS tax Form 1099-MISC is used to report miscellaneous income such as rent, prizes, healthcare payments, awards, and payments to attorneys. Before the year 2020, this tax form was used to report non-employee compensation, but from the year 2020 this was discontinued and 1099-NEC is used to report the same.
Where is Form 1099-MISC used?
The Tax Form 1099-MISC is used to report miscellaneous compensation such as prizes, rents, awards, etc. A taxpayer would receive this tax Form if they have been paid $10 or more in the form of royalties, or have paid $600 or more as other miscellaneous income during the tax year. The tax Form is sent to each person, to whom at least $600 has been paid under the following categories.
- Prizes and awards
- Rents – Real estate agents and property managers report the rent paid to the property owners, or report the office space rent that has been paid.
- Medical and healthcare payments
- Crop insurance proceeds
- Cash payments for fish payments or other aquatic life
- Cash paid from a notional principal contract that has been made to an individual or partnership
- Payments to an attorney
- Payments towards fishing boat proceeds.
The IRS Tax Form 1099-MISC is also used to report direct sales of more than $5000 of consumer products to a buyer for resale anywhere, other than a permanent retail establishment. The taxpayer should send the tax Form to the recipient by February 1st of the tax year and file it with the IRS by March 1st.
There are many different versions of this tax Form. Copy A of Form 1099-MISC appears in red and it is strictly for IRS use only. Copy 1 of the Form goes to the recipient’s state tax department. Copy B goes to the recipient and Copy 2 of the tax Form is sent to the recipient for their state tax return. Copy C of the Form is retained by the payer for recording purposes.
Who should file Form 1099-MISC?

As this tax Form is used to report payments to others in the course of a business, self-employed individuals, freelancers, and independent contractors can file and receive this Tax Form depending on the nature of their trade or business. Taxpayers should also file Form 1099-MISC for each person to whom they have withheld federal income tax under the backup withholding rules, regardless of the amount of the payment. The deadline to send the Form is January 31st. The due date to file 1099 Form with the IRS, through paper filing is February 28th, 2023. The deadline for e-filing this tax Form is March 31st, 2023.
